Terms of Use & Conditions

Effective Date: September 23, 2026 | Platform Version: TypingYard 2.4

1. Agreement to Terms & Binding Contract

By accessing, browsing, testing on, creating mock exam rooms on, or otherwise utilizing TypingYard (typingyard.com), you enter into a legally binding contract with TypingYard and agree to comply strictly with these Terms of Use and all applicable laws. If you disagree with any portion of these terms, you must discontinue platform use immediately.

2. Scope of Service & Educational License

TypingYard grants you a non-exclusive, non-transferable, revocable, personal license to access our typing tests, keyboard drills, exam room simulations, arcade games, and educational guides for personal, self-evaluation, and educational training purposes.

All Words Per Minute (Gross WPM, Net WPM) calculations, keystroke rhythm indicators, accuracy percentages, and simulated evaluation deductions are proprietary algorithmic approximations designed strictly for training and self-improvement.

3. User Eligibility & Minors

You represent that you are at least 13 years of age (or the legal age of digital consent in your jurisdiction). Users under the age of 18 may only use TypingYard under the supervision and with the express consent of a parent, legal guardian, or accredited educational institution.

4. Prohibited Conduct & Platform Security

You agree not to engage in any of the following prohibited activities:

  • Deploying automated keystroke scripts, auto-typers, macro bots, headless browser automation, or memory injectors to manipulate score metrics or leaderboards.
  • Overburdening, attacking, or disrupting server infrastructure (including Distributed Denial of Service (DDoS) attacks, port scanning, or rate limit circumvention).
  • Attempting to reverse-engineer, decompile, disassemble, or extract underlying source code or algorithmic models from TypingYard.
  • Scraping, harvesting, mirroring, or systematically republishing TypingYard practice content, curriculum text banks, keymaps, or UI assets without prior express written authorization.
  • Submitting malicious payloads, SQL injections, prompt injections, or unlawful content through our API endpoints, contact forms, or custom passage creator.

5. Institutional Exam Simulator & Mock Room Disclaimers

TypingYard provides tools allowing instructors, organizations, or individuals to generate private exam rooms, assign custom passages, and review attempt logs:

  • Technology Provider Status: TypingYard operates solely as a technological software platform and is NOT an official examining authority, proctor, invigilator, or certifying agency.
  • Independent Verification: TypingYard does not authenticate candidate physical identity, verify keystroke biometric authenticity, or supervise candidate physical environments. Institutions and educators are solely responsible for physical invigilation and candidate verification.
  • No Dispute Involvement: TypingYard disclaims all liability and will not mediate disputes between exam creators, instructors, testing candidates, or recruiting bodies.

6. AI-Generated Practice Tools & Dynamic Content

Certain features (e.g. AI Speed Coach and dynamic passage generation) utilize algorithmic generative models. You acknowledge that AI-generated feedback and practice passages are created dynamically. While we enforce strict sanitization and quality filters, TypingYard does not warrant that AI-generated outputs are factually infallible, error-free, or compliant with any specific civil service examination syllabus.

7. User Passages & Copyright Safe Harbor (DMCA)

If you input custom passages or examination materials, you represent and warrant that you hold all necessary copyright ownership or licensing permissions. You must not submit defamatory, infringing, or unlawful content.

TypingYard complies with the Digital Millennium Copyright Act (17 U.S.C. ยง 512). If you believe material hosted on our site infringes your copyrighted work, please notify our designated DMCA agent at contact@typingyard.com with complete documentation.

8. Intellectual Property Ownership

The TypingYard brand name, trademarks, trade dress, logos, 3D graphical keycap assets, software architecture, pre-rendering pipelines, and proprietary drill algorithms are the exclusive intellectual property of TypingYard and protected by international intellectual property laws.

9. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TYPINGYARD PLATFORM, ALL SOFTWARE ENGINES, EXAM ROOMS, TYPING EXERCISES, AI FEATURES, AND EDUCATIONAL GUIDES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TYPINGYARD EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10. COMPREHENSIVE LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TYPINGYARD, ITS FOUNDERS, OPERATORS, AFFILIATES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, WORK INTERRUPTION, EXAM FAILURE, EMPLOYMENT DISQUALIFICATION, ACCREDITATION REJECTION, OR HARDWARE MALFUNCTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED FIFTY UNITED STATES DOLLARS ($50.00 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless TypingYard, its operators, contractors, and agents from and against all third-party claims, damages, liabilities, losses, and legal costs arising from: (a) your use or misuse of the platform; (b) your breach of these Terms; or (c) custom text or materials uploaded by you that infringe any third-party intellectual property or privacy right.

12. Dispute Resolution, Class Action Waiver & Severability

You agree that any dispute arising out of or relating to these Terms shall be resolved on an individual basis. You explicitly waive any right to bring or participate in any class action, collective lawsuit, or representative proceeding. If any provision of these Terms is deemed unlawful or unenforceable, that provision shall be severed without affecting the validity of the remaining provisions.
